TERMS & CONDITIONS FOR FREE CAR SEAT REPLACEMENT
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO SUBMIT AN ENTRY FORM OR RECEIVE A FREE REPLACEMENT CAR SEAT.
By submitting an entry form for this Car Seat Replacement Giveaway (the “Contest”), you will be bound by these Terms & Conditions, and you acknowledge that you satisfy all eligibility requirements.
Eligibility. Open to individual legal residents of the 50 United States or the District of Columbia who (i) are the legal age of majority in their place of residence prior to the date of entry, (ii) have been the driver or a passenger of a motor vehicle involved in an accident within the thirty (30) days prior to the date of entry (the “Accident”) and at the time of such Accident such motor vehicle contained at least one (1) child safety car seat, and (iii) submit all required information on the entry form on this webpage (or otherwise located at www.theaaagroup.com/free-car-seat-replacement/) (the “Entry Form”).
Administrator. The Administrator of the Contest is The Auto Accident Attorneys Group by Salimi Law, LLC (the “Firm”).
Prize. The Firm will award one (1) or more new child safety car seats to eligible individuals using the selection method identified below. The brand and model of the prize will be at the Firm’s sole discretion. If multiple child safety car seats were involved in the Accident, the Firm reserves the right to determine in its sole discretion whether to award more than one (1) new child safety car seat. Each prize will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). If you win a prize, you may not transfer, assign, or redeem the prize for cash.
Limit one award of a prize per person and household per Accident.
Winner Selection Method. The Firm will review each eligible participant’s Entry Form and the Accident upon its receipt of (i) the Entry Form submission and (ii) an official police report for the Accident. The Firm will then evaluate the Accident, including but not limited to its effect on the child safety car seat that the eligible participant requests be replaced and the need to replace the affected child safety car seat, using a variety of factors at its sole discretion, including but not limited to the guidelines provided by the National Highway Traffic Safety Administration.
Winner Notification and Responsibilities. If you are a winner, an e-mail notification will be sent to you by the Firm (the “Free Car Seat Notice”). Prizes will be delivered by the Firm using the shipping address provided in the Entry Form, or as updated by the winner upon receipt of the Free Car Seat Notice. Throughout the term of this Contest, you will provide the Firm with any forms, documents, or certifications as may be reasonably required for the Firm to satisfy any information reporting with respect to this Contest.
How to Enter. You may enter the Contest by completing and submitting the Entry Form online.
Disclosure in Connection with Publicizing Entry. If you choose to promote your entry via social media or other channels, you should disclose your connection to the Contest. For example, it may be sufficient to include a statement such as #FreeCarSeatReplacement.
Additional Terms. The Firm reserves the right to modify or cancel a Contest at any time. The Firm and its affiliates are not responsible for: (a) lost, misdirected, late, or incomplete entries or for inaccurate entry information or (b) any operation or transmission error, theft, unauthorized access to, or alteration of, entries. The Firm may disqualify any individual found to be: (x) tampering with a Contest; (y) violating these Terms & Conditions; or (z) acting in an unsportsmanlike or disruptive manner or with intent to threaten or harass any person. Incomplete and robotic, automatic, programmed, or similar entries will be disqualified.
Miscellaneous. Each Contest is governed by the laws of the United States. By entering a Contest, you agree (for yourself and your heirs) that the Firm and each of its affiliates and agents, and any entity involved in any aspect of the Contest (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury, or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use, or misuse of a prize or participation in the Contest, even if caused or contributed to by the negligence of any of the Released Parties.
You agree that the Firm’s decisions related to each Contest and all distribution of prizes are final. Each winner agrees that, by participating in a Contest, the Firm and its respective affiliates may use the winner’s name in any manner and in any medium for its promotional purposes without additional compensation, including posting in a winner’s list, except where prohibited by law, and the Firm and each of its affiliates may be required to disclose the winner’s address to state regulatory authorities.
Limitation of Liability. NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS & CONDITIONS, FOR ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST, INCLUDING IN ANY WAY RELATED TO A PRIZE AWARDED BY THE FIRM HEREUNDER, IN NO EVENT, WHETHER BASED IN CONTRACT OR TORT (INCLUDING, WITHOUT LIMITATION, FOR BREACH OF WARRANTY, NEGLIGENCE, AND STRICT LIABILITY IN TORT), WILL THE FIRM NOR ANY OF ITS AFFILIATES AND AGENTS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, OR FOR LOSS OF REVENUE, LOSS OF BUSINESS, OR OTHER FINANCIAL LOSS.
