Georgia Child Car Seat Laws

Like all other states in the country, Georgia child car seat laws require that you have appropriate seats for children depending on their age and size. Car seats help protect children in the event of an accident in a way that a seat belt can’t do for someone who’s not the size of an adult. But what happens if you are in a collision?

Child Car Seat Laws in Georgia

To help keep children safe as they travel by car, Georgia requires that you obey the following car seat laws.

Children Sit in the Back

Georgia law requires that children under eight and shorter than 57 inches sit in the back seat. The front seat is equipped with airbags. Although airbags are essential safety devices that can prevent catastrophic injuries in adults, they can hurt children.

There are exceptions to this law. If the vehicle doesn’t have a back seat, the child can sit in the front as long as they weigh at least 40 pounds and are in a booster seat.

Children Under Eight Must Use a Child Restraint System

Children under the age of eight must use a restraint system that is appropriate for their age and size. Georgia only requires that you keep them rear-facing for 12 months, but it’s a good idea to wait until they’re two or three years old before changing them to a front-facing seat.

Once a child is at least 12 months old and weighs 21 pounds, they can sit in a front-facing seat. Keep in mind that they must weigh at least 21 pounds; otherwise they have to remain in the rear-facing seat, no matter how old they are.

Once a child is at least 40 pounds, they can transition to a booster seat. Children between one and seven years old have to use a booster seat with a shoulder and lap belt.

When your child reaches eight years of age and is at least 4 feet 9 inches tall, they can transition to sitting with only a seat belt.

What To Do If You’re Involved in a Car Accident in Marietta

If you’re involved in a car accident and you or your child is injured, you can file a claim to get compensation. Because Georgia is a fault-based state, you will need to prove that the other party caused the accident to recover damages. The best thing you can do is hire an experienced car accident attorney.

What does a car accident lawyer do? They can help you gather the evidence you need to prove that you deserve compensation while also negotiating with insurance companies to achieve a fair settlement. If that’s not possible because the insurer disputes the claim, your lawyer can take the case to court.

You should contact our legal team as soon as possible to start the process. You’ll have a much better chance of receiving money for your losses if you get the process started early.
